King Street Drug Overdose Leads to Heroin Arrest

Police were called when a woman overdosed on drugs, and the incident led to the arrest of a King Street man for possession of heroin.

 

A Wilmington man was arrested after a woman suffered a drug overdose outside of a King Street home on Tuesday afternoon.

Police Lt. Joe Desmond said a call came in at 3:33 p.m. on Tuesday from 29A King Street for a suspected overdose. When officers arrived they found a young female on the ground in front of the house who was, according to Desmond, responsive but “not doing well.”

The Wilmington Fire Department took over the scene and treated the woman until her breathing improved and she could be transported to a local hospital.

In an effort to find out what had caused the woman to collapse on the property, officers entered the home and found heroin, pills and other drug paraphernalia inside.

Joshua Kivlehan, 18, of 29A King Street, was arrested at the scene and charged with possession of Class A drugs for allegedly having heroin at the home.

The female was only given a civil citation because there was a small amount of marijuana in her vehicle. According to Desmond, even though the woman likely overdosed on heroin, there is no way of charging her for possession because the drug was in her system.

“The difficulty is that we know she took it, but she was outside of the house and not with the drugs. You really can’t charge her because you cannot be in possession of drugs when it’s inside your body,” said Desmond. “It’s inside her at that point, so it comes down to a matter of how do you prove it? That’s just the way the law is, and maybe there is a flaw in the law."

Desmond said he’s seen multiple overdoses during his shifts in the last two months, including a pair that came during the same call.

“It’s something that is a constant issue we deal with,” said Desmond. “It’s sad because in most cases it’s young people. They get hooked at a young age and it’s a difficult drug to kick.”

One person does not equate to massive. I am not saying that there is not drugs - every town has them, but once again, jumping all over a problem to make it look larger than likfe over a reported incident. I think that Treasure Hill has a massive problem with looking like the town junk yard, but I guess that's my interpertation of it, like this is yours.

I think when something is in your body, you basically 'possess' it. And you prove it when you treat her for an overdose. Goofy interpretation of the law.

webmom, good observation regarding possession. One can indeed be in possession of something that is in their bloodstreams. Many juveniles/minors are charged with "minor in possession of alcohol" when its in their bloodstream. Police officers should be commended for their courageous acts and occupations, but not necessarily for their interpretation of the law.

If you dont like it mabey you should consider moving out of the neighborhood since you have so much money and look down on low income housing !

I am not trying to pass judgement. That house is part of a low income housing program. The mother was arrested a few weeks back on a different charge. There are many young children who live in that neighborhood that do not need to be exposed to continuing issues.

Really, so he is the only one in the neighborhood with a drug problem???? There's quite a few on that street, so unless you plan on driving all of them out of the neighborhood I suggest you just worry about taking care of your children and only pray it doesn't happen to them. The real issue is the suppliers. Why don't you consider that.

I agree with you Laura. I, too have young children, and if this was going on in my neighborhood I would want it dealt with too. And Melissa, you stated that their is not a massive drug problem in Wilmington.... well unfortunately you are wrong. Heroin is the drug of choice for many of our teenagers and young adults. It is cheap and easily accessible. Many of our neighboring towns are dealing with these same issues. It is deadly and extremely dangerous. Once these young kids get hooked its a lifelong struggle that often ends tragically. We, as a community, cannot close our eyes to this problem.

You all have your facts wrong, the mother was never arrested ?That is all just talk from the Nosey neighbors causing drama, if your really so conceded about the high percentage of drug addicts in this town , than do something other than bash the addicts. And he was arrested on charges cause of his girlfriend being drunk and saying he hit her, when he didn't. I would know considering I'm his girlfriend. Wilmington has soooo many heroin addicts in this town it's disgusting, it's an epidemic and they need help not jail it's not going to help. Why he was arrested and they aren't looking for the drug dealers makes no sence. It's in all the neighborhoods, and he's not the only one on that street who's had drug issues and overdoses. someone died on king st 3 years ago and there was another overdose a few weeks back. You people should stop blaming the drug addicts because you don't understand, it could happen to your kids. The deals are who should be getting arrested! It's not going to stop unless they take the heroin out of the streets.

Addicts are not going to reveal their sources, nor do they want jail OR hospitalization, especially if they've been arrested soon after using. What they want is more drugs to keep them from getting sick from withdrawals. Unfortunately for them and everyone else, they are not using to get high, they are using to keep from getting ill...neither jail or hospitalization can help that. Only the users can keep themselves from using. They have to be willing to be ill for weeks, sometimes months. It's very, very painful and unpleasant. What they don't realize is that after the pain and displeasure comes joy. They don't know or see that.

Its wrong to Even attempt at blaming the victim in this situation. She probably would of died if she had not made it out of that house as she did. Wilmington has a terrible
Problem with heroin and the police arresting people involved in an overdose just makes it so the young adults are mOre scared to call 912 for help when they really need it because they are in fear for themselves too.

This is soo true!!!! They are all willingly doing drugs together knowing that something bad could happen and they are all just as guilty and should be going to treatment!!! Most drug addicts are in fear of calling 911 for that very reason, they don't want to get arrested.

What you should be saying is no more ,the young adults in this town are polluting are young children, what consequences are enforced on these parasites. If its ok. by law that an 18 year old be allowed to hang with and pray on 13 year olds and so on, where is the help for the young kids and the parents who suffer because of parasites like him!!!!

Lets see the girl was shooting up in.her car not the house you didntknow that how come you havent looked around your neighborhood to much laura as your.street has a few more addicts and thats a fact. Lets hope your children dont get.caught up in this drug epidemic. Now the mother is agood mom . She has not been arrested, she has been trying to help her son. He has a illness, and addiction is an illness just like alcoholism, should we remove them from the neighborhood too? If your really in fear for your children you should really get educated on addiction problems. Its a long hard battle to overcome. How would you feel if your child became a addict? What would you do? He is a parasite a predator and a women beater, the Apple doesn't fall far from the tree. Wrong he does hang and do drugs with younger people, known fact. Shame on any adult he lives with to just allow any of this to go on!!!!! Look at the situation.....Yes, drugs are in this neighborhood thanks to a particular house long roots back, seen same things go on daily, and on it goes...No he did not always live here either, maybe he should go back where he came from!!! Actually maybe staying in jail would be a blessing in disguise for all!!!!

Joshua comes from a very loving mother and a very stable home it just so happens he fell into the wrong crowd of kids who were using drugs and he then got involved and is now struggling with an addiction . You have no idea what goes on in their home so please do not assume anything because it only makes a real ass out of you . You should really educate yourself on drug addiction instead of bashing a young man who needs help . Go do something construtive and like I said educate yourself ........ brecause your ignorance is deplorable .......

WOW, some of these comments shock me! Being addicted to drugs has a HUGE affect on a HUMAN's brain. It takes over the addicts brain. Do your research people! My sister has struggled with being an addict for 12 years (and I didnt grow up in Wilmington..she lives on the North Shore). It's an epidemic. I find it hard to hear that some of you think that it is the parents FAULT. People become addicts for so many reasons. Either they dont feel good about themselves, past history of life events, or like my sister she got into a car accident and was prescribed oxy..which spiraled and heroin become her drug....It is very hard to watch someone you love be an addict and never get better. There needs to be more education about what it can do to you and all the people you love if you decide to use. Please educate yourselves before you judge. I no longer have a relationship with her, but still love and prayer for her everyday.

Of course addiction is a disease but for any parent to allow what comes with it into their home is a disgrace on their part. ( drugs in the home ) Why not just serve it up, especially when you have younger siblings in the home. I am educated and very aware and for the people who find themselves in this situation due to serious injury I do feel for, as for the willing tell me why I should ? It is awful to watch but when you choose to allow it in you're home , well I guess you reap what you sew. You say I have no idea what goes on in that home, think again. It is by far no big secret!!!!! I do not have sympathy for anyone who allows this parasitic lifestyle into there home and allows it to go on for years. Neighbors may not be so nosey if the drama wasn't right in front of them!!!

Again you are very very wrong !!!! Joshua's mother never ever willingly or knowingly let drugs into her home . The only way you would know what goes on behind closed doors is if you are doing some snooping and if thats the case then there is a serious problem. Other than that like I said you have no idea what goes on behind closed doors because you do not live in the home !!!! Once you are an addict you are no longer willing. It has become a habit and without the drug you get violently sick amongst many other withdrawal symptoms sometimes including death , so that shows where you're education lies as far as addiction .. Thank you very much I rest my case .. you really need to worry about your own busisness and hope and pray that some day one of your children never ends up drug addicted, because even those with all the money in the world and the " BEST LIVES " LOL end up addicts ......U are a disgrace and a poor excuse for an adult .... to all who posted on this issue. It is no surprice to a lot of Wilmington residents about the drugs in this town. He has been in detaox for drugs and has been arrested for some other things. Yes maybe as parents we do turn a blind eye to what our kids do but it doesnt make her a bad mom. As far as the girl friend goes you are only 17 and before you met him he has had a temper and a drug problem now he has turned you in to a user. King street has lost a great kid 3 years ago over drugs its in this town and in every town.

Ok where do you get he turned her in to a drug user? Girl friend had been in rehab and was a run away on more than one time does some drugs .and this was before they became girl freind and boy freind . They hooked up hanging with the same kids. What does a temper have to do with using.

I have to agree addiction is a disease and these kids need help and we as a town need to do something before more kids become victims.
That being said, Mumsie and Dershalll you blame the dealers? Turn them in then! As far as nosey neighbors? Stop leaving your used needles on the ground and they may stop caring so much about what you do. Their issue is that you are endangering them and their families now.
